I have not hunted with a gun in many years and my grandfather said divers were not good to eat so I never wanted to eat one so never shot any.

From what I can tell you are correct they are protected in all states where federal migratory bird protections are in place and according to my count of the list that is 50 states including Idaho.

I saw two hunters who asked if hunting was allowed there. It is.
 
I heard them shooting later and saw them waiting for a couple of Eared Grebes to float in with the wind they found out it was not wadable where they were. I told them the birds were not very good to eat but they said they ground them up for sausage and jerky.
